Yes, if the timeshare is title based. A transfer CANNOT proceed until the original Title deed has been located.
Possession of this document is not essential and a statutory declaration can be prepared where it cannot be located.
Any outstanding levies will be deducted from the settlement monies. Where the overdue amount is greater than the sale price, the vendor will first have to make payment of the difference before the sale can proceed.
